Tax Audits - Federal and State

Tax audits (examinations) are intimidating and overwhelming.  Whether it is a federal or state examination, the taxpayer is required to prove the accuracy of the return.  Taxpayers under examination are required to produce documentation for review and to be questioned by revenue agents.  Facing this alone, can be a terrifying experience, but worse, it can lead to unjustified assessments.  An experienced tax attorney can help ensure your rights are protected and the examination is resolved favorably.   

Tax & Estate Planning

Tax and estate planning is critical to preserving your assets by minimizing tax.  We partner with you, your financial advisors, CPAs and other professionals to provide strategic tax planning advice.  Charitable contributions and other tax avoidance techniques get intensely scrutinized by the IRS and state tax authorities.  We help ensure you tax planning tools survive any future audits by perfecting them at the beginning of the process.  We also provide wills, trusts, powers of attorney and other relevant estate planning documents. 

Tax Appeals - Federal and State

The IRS and all states have administrative appeals for proposed tax assessments.  Appeals offer you an opportunity to challenge proposed assessments before they become final.  Appeals focus on the facts of the case and the applicable law.  Having an experienced tax attorney is critical to presenting your appeal properly and resolving your case without having to go to court.  

Tax Litigation

Federal tax litigation is in the United States Tax Court or federal district court.  The Tax Court reviews proposed deficiencies, collections determinations, certain penalties and passport revocations.  The federal district courts adjudicate refund suits against the IRS, as well as suits challenging IRS collection actions, such as levies and seizures of property.  A taxpayer with a Notice of Deficiency has only 90 days to petition the Tax Court before the proposed assessment becomes final.  

Tax Debt Relief & Collections

Regardless of the source of a tax debt, the IRS, and most states, have administrative procedures for ensuring your tax debt does not prevent you from financially supporting yourself or keeping your business operating.  We provide comprehensive representation before IRS Revenue Officers and can assist with liens, levies and garnishments.  We also work with our clients on Penalty Abatements, Collection Due Process Hearings, Installment Agreements, Offers in Compromise, Innocent Spouse Relief. 

Tax Penalties

Reiter Tax Law can defend you, or your business, against assessments of the Trust Fund Recovery Penalty or Return Preparer Penalties.  These penalties can present significant financial risk to you personally or to your business.  Having an experienced tax attorney at your side in responding to these penalties is critical.  You must respond to any proposed penalties in a timely and thorough manner.

Passport Revocation

When a taxpayer has a seriously delinquent tax debt, the IRS certifies the debt to the State Department.  The State Department will revoke the taxpayer's passport which prevents you from leaving the US.  You have the right to challenge the proposed passport revocation in US Tax Court.  If the revocation is already effective, we can assist you in getting your passport reinstated.

Rick earned his J.D., with honors, from The George Washington Law School and his LL.M. in Taxation, with distinction, from Georgetown University Law Center.  He has practiced law for over 24 years and practiced exclusively tax law since 2012.  His experience includes representing individual and business clients, representing the IRS in US Tax Court litigation, and leading the Tax Controversy practice for a Top 8 accounting firm.  He has appeared as counsel in over 300 US Tax Court cases.  He has litigated cases in a wide range of substantive areas, including individual and business income tax, research & development credits, conservation easements, microcaptive insurance, partnerships and more. He has represented numerous taxpayers during exams before both the Small Business/Self-Employed and Large Business & International divisions and in appeals to the IRS Independent Office of Appeals.  At the state level, he has defended individuals and businesses facing income tax audits, sales tax audits and collections.  He has successfully negotiated numerous offers in compromise and installment agreements.  He has successfully argued for abatement of penalties for hundreds of taxpayers.
